Maryland Elevator & Conveyance Licensing Law

The following is the full text of Maryland’s elevator & conveyance licensing law statutes as published in the Maryland Code. For the official version, see the Maryland Legislature.


Md. Code, Bus. Occ. & Prof. GBO 17-205

§17–205.

(a)    (1)    The Secretary shall appoint the executive director of the Commission from a list of 3 nominees submitted by the Commission.

    (2)    The executive director serves at the pleasure of the Secretary.

(b)    The executive director shall:

    (1)    possess a broad knowledge of generally accepted practices in the real estate business in the State; and

    (2)    be reasonably well informed of the general laws that govern agency and contracts for the conveyance or leasing of real estate.

(c)    (1)    The executive director shall devote full time to the duties of office.

    (2)    The executive director may not hold any position or engage in another business that:

        (i)    interferes with the position of executive director; or

        (ii)    might conflict with the position of executive director.

    (3)    While employed by the Commission, the executive director may not:

        (i)    be licensed in any state as a real estate broker, an associate real estate broker, or a real estate salesperson;

        (ii)    engage in any act for which a license is required under this title; or

        (iii)    in connection with any real estate transaction, directly or indirectly receive or become entitled to receive any fee, perquisite, or compensation.

(d)    The executive director is entitled to:

    (1)    compensation in accordance with the State budget; and

    (2)    reimbursement for expenses under the Standard State Travel Regulations, as provided in the State budget.

(e)    The executive director is a special appointment in the State Personnel Management System.

(f)    While employed as executive director, the executive director shall be covered by a surety bond or an insurance policy of the type and in the amount of coverage determined by the State Treasurer under § 5–108 of the State Government Article.

§4–101.

(a)    In this title the following words have the meanings indicated.

(b)    “Apprentice barber” means an individual who, under the supervision of a master barber, is learning to practice barbering or to provide barber–stylist services in a barbershop that holds a barbershop permit.

(c)    “Barber” means an individual who practices barbering.

(d)    “Barber–stylist” means an individual who provides barber–stylist services.

(e)    (1)    “Barbershop” means any commercial establishment, except a beauty salon, in which an individual practices barbering or provides barber–stylist services.

    (2)    “Barbershop” includes a mobile barbershop.

    (3)    “Barbershop” does not include a clinic in a barber school.

(f)    “Barbershop permit” means a permit issued by the Board to operate a barbershop.

(g)    “Board” means the State Board of Barbers.

(h)    (1)    “License” means, unless the context requires otherwise, a license issued by the Board to practice barbering or to provide barber–stylist services.

    (2)    “License” includes, unless the context requires otherwise, each of the following licenses:

        (i)    a master barber license;

        (ii)    a barber license; and

        (iii)    a barber–stylist limited license.

(i)    (1)    “Limited license” means a license issued by the Board to practice barbering as limited in § 4–301 of this title.

    (2)    “Limited license” includes, unless the context requires otherwise, a limited license to provide barber–stylist services.

(j)    “Master barber” means a barber who:

    (1)    has at least 15 months experience as a licensed barber; and

    (2)    has passed a test approved by the Board.

(k)    “Mobile barbershop” means a barbershop that is located in a motor vehicle or a trailer that is designed, constructed, and equipped as a place for an individual to practice barbering and for use as a conveyance on highways.

(l)    (1)    “Practice barbering” means to provide to an individual for compensation the service of:

        (i)    cutting, razor cutting, styling, relaxing, body waving, shampooing, or coloring the hair;

        (ii)    shaving or trimming the beard;

        (iii)    massaging the face;

        (iv)    designing, fitting, or cutting a hairpiece; or

        (v)    performing any other similar procedure on the hair, beard, face, or hairpiece of the individual.

    (2)    “Practice barbering” does not include:

        (i)    the mere sale of wigs or hairpieces; or

        (ii)    the services performed by an employee under the supervision of a master barber in a barbershop that holds a barbershop permit that are restricted to:

            1.    shampooing;

            2.    removal of a hair solution;

            3.    sterilization of equipment; or

            4.    similar activities.

(m)    “Provide barber–stylist services” means to provide to an individual for compensation the service of:

    (1)    cutting, razor cutting, or styling the hair;

    (2)    shaving or trimming the beard;

    (3)    massaging the face; or

    (4)    performing any other similar procedure on the hair, beard, or face of the individual.

§5–101.

(a)    In this title the following words have the meanings indicated.

(b)    “Apprentice” means an individual who is learning to practice cosmetology or any limited practice of cosmetology in a beauty salon that holds a beauty salon permit under the supervision of:

    (1)    if learning to practice cosmetology, a licensed senior cosmetologist;

    (2)    if learning to provide esthetic services, a licensed senior cosmetologist or a licensed esthetician with 2 years’ experience;

    (3)    if learning to provide hair services, a licensed senior cosmetologist or a licensed hairstylist with 2 years’ experience; and

    (4)    if learning to provide nail technician services, a licensed senior cosmetologist or a licensed nail technician with 2 years’ experience.

(c)    (1)    “Beauty salon” means any commercial establishment, except a barbershop, in which an individual practices cosmetology.

    (2)    “Beauty salon” includes a mobile beauty salon.

    (3)    “Beauty salon” does not include a clinic in a cosmetology school.

(d)    “Beauty salon permit” means a permit issued by the Board to operate a beauty salon.

(e)    “Board” means the State Board of Cosmetologists.

(f)    “Cosmetologist” means an individual who practices cosmetology.

(g)    “Hairstylist” means an individual who provides hair services.

(h)    “Hairstylist – blow dry technician” means an individual who provides hair services – blow drying;

(i)    (1)    “License” means, unless the context requires otherwise, a license issued by the Board.

    (2)    “License” includes, unless the context requires otherwise, each of the following licenses:

        (i)    a license to practice cosmetology;

        (ii)    a license to practice as a senior cosmetologist;

        (iii)    a limited license to provide esthetic services;

        (iv)    a limited license to provide hair services;

        (v)    a limited license to provide hair services – blow drying;

        (vi)    a limited license to provide nail technician services; and

        (vii)    a limited license to provide eyelash extension services.

(j)    “Licensed cosmetologist” means, unless the context requires otherwise, a cosmetologist who is licensed by the Board to practice cosmetology.

(k)    “Licensed senior cosmetologist” means a person who:

    (1)    has at least 2 years of experience as a licensed cosmetologist; and

    (2)    has passed a test approved by the Board.

(l)    (1)    “Limited license” means a license issued by the Board to practice cosmetology as limited in § 5–301 of this title.

    (2)    “Limited license” includes, unless the context requires otherwise, each of the following licenses:

        (i)    a limited license to provide esthetic services;

        (ii)    a limited license to provide hair services;

        (iii)    a limited license to provide hair services – blow drying;

        (iv)    a limited license to provide nail technician services; and

        (v)    a limited license to provide eyelash extension services.

(m)    “Mobile beauty salon” means a beauty salon that is located in a motor vehicle or a trailer that is designed, constructed, and equipped as a place for an individual to practice cosmetology and for use as a conveyance on highways.

(n)    (1)    “Practice cosmetology” means to engage in any of the following for compensation:

        (i)    providing hair services;

        (ii)    arching or dyeing eyebrows;

        (iii)    dyeing eyelashes;

        (iv)    providing esthetic services;

        (v)    providing nail technician services; or

        (vi)    providing eyelash extension services.

    (2)    The practice of cosmetology does not include:

        (i)    the mere sale, fitting, or styling of wigs or hairpieces;

        (ii)    the mere shampooing of hair; or

        (iii)    a service that results in tension on hair strands or roots by twisting, wrapping, weaving, extending, locking, or braiding by hand or mechanical device, provided that the service does not include the application of dyes, reactive chemicals, or other preparations to alter the color of the hair or to straighten, curl, or alter the structure of the hair.

(o)    (1)    “Provide esthetic services” means to provide to an individual, for compensation, the service of:

        (i)    cleansing, exercising, exfoliating, massaging, cosmetic microneedling, stimulating, toning, or performing any other similar procedure on the skin or scalp by electrical, mechanical, or any other means;

        (ii)    applying to the face, body, or scalp an alcohol, cream, lotion, astringent, or cosmetic preparation;

        (iii)    removing superfluous hair by the use of electrical, mechanical, or any means other than by the use of a laser light–based device; or

        (iv)    providing eyelash extension services.

    (2)    “Provide esthetic services” includes:

        (i)    applying eyelash extensions;

        (ii)    performing superficial exfoliation treatments of the epidermis using professional and other commercially available products or devices;

        (iii)    performing treatments for the relaxation, hydration, contouring, and beautification of the face, skin, body, eyelashes, or eyebrows; and

        (iv)    performing nonablative skin rejuvenation.

    (3)    “Provide esthetic services” does not include:

        (i)    the diagnosis of illness, disease, or injury; or

        (ii)    performing ablation of the dermis or hypodermis.

(p)    “Provide eyelash extension services” means to provide to an individual, for compensation, the service of:

    (1)    cleaning the eye area;

    (2)    applying:

        (i)    eyelash primers and adhesives;

        (ii)    eyelash extensions; and

        (iii)    sealant; or

    (3)    drying the eye area for eyelash extensions.

(q)    “Provide hair services” means to provide to an individual for compensation the service of beautifying, cleaning, or embellishing the hair of the individual by:

    (1)    arranging the hair;

    (2)    bleaching the hair;

    (3)    cleansing the hair;

    (4)    coloring the hair;

    (5)    curling the hair;

    (6)    cutting the hair;

    (7)    dressing the hair;

    (8)    singeing the hair;

    (9)    permanent waving the hair;

    (10)    waving the hair; or

    (11)    performing any other similar procedure intended to beautify, clean, or embellish the hair.

(r)    “Provide hair services – blow drying” means to provide to an individual for compensation the service of beautifying, cleaning, or arranging the hair of the individual by:

    (1)    arranging the hair;

    (2)    cleansing the hair;

    (3)    curling the hair;

    (4)    dressing the hair;

    (5)    blow drying the hair;

    (6)    singeing the hair; or

    (7)    performing any other similar procedure intended to beautify, clean, or arrange the hair.

(s)    “Provide nail technician services” means to provide to an individual, for compensation, the service of:

    (1)    manicuring or pedicuring the individual’s nails;

    (2)    applying artificial nail enhancement products; or

    (3)    maintaining artificial nail enhancement products.

§10–101. (a) In this title the following words have the meanings indicated. (b) (1) “Conveyance” means a carrying or transporting device that has a capacity that exceeds 1,749 gallons exclusive of the fuel supply tank for its own propulsion. (2) “Conveyance” includes a pipeline, tank car, vehicle, and vessel. (c) “Dyed diesel fuel” means diesel fuel that is dyed under U.S. Environmental Protection Agency rules for high sulfur diesel fuel or is dyed under Internal Revenue Service rules for nontaxable use. (d) (1) “Gasoline” means a product that: (i) is used as fuel in a spark ignited, internal combustion engine; or (ii) is designated as gasoline by the Comptroller. (2) “Gasoline” includes: (i) casing head gasoline; (ii) absorption gasoline; (iii) other natural gasoline; and (iv) aviation gasoline, as defined in § 9-101(c) of the Tax - General Article. (e) “Motor fuel” means: (1) gasoline; or (2) special fuel. (f) “Motor vehicle” means a vehicle that: (1) is self-propelled; (2) is designed to be operated on a public highway; and (3) is not operated only on rails. (g) “Petroleum transporter” means a person who transports motor fuel in interstate or intrastate commerce in a conveyance, whether or not the person owns the conveyance. (h) “Producer” means a company, or agent, parent company, subsidiary, or joint venture of a company, that extracts crude oil from the earth. (i) (1) “Propulsion tank” means a receptacle on a motor vehicle from which motor fuel is supplied for the propulsion of the vehicle. (2) “Propulsion tank” includes a fuel supply tank of a motor vehicle. (j) “Refiner” means a person who makes motor fuel from crude oil by changing the physical or chemical characteristics of the crude oil. (k) “Retail service station dealer” means a person who operates a retail place of business where motor fuel is sold and delivered into the fuel supply tanks of motor vehicles. (l) (1) “Special fuel” means a product that is usable as fuel in an internal combustion engine. (2) “Special fuel” does not include gasoline. (m) “Vehicle” means a conveyance for transporting motor fuel on a public highway.PreviousNext

§15–101. (a) (1) For purposes of this section the following words, as used in federal bankruptcy laws, have the meanings indicated. (2) “The case” means the assignment for the benefit of creditors proceeding or the receivership proceeding, whichever is applicable; (3) “Commencement of the case” means commencement of the assignment for the benefit of creditors proceeding or receivership proceeding; (4) “The court” means the court in which the assignment for the benefit of creditors proceeding or receivership proceeding is filed; (5) “Date of the filing of the petition” means the date of the commencement of the assignment for the benefit of creditors proceeding or receivership proceeding; (6) “Debtor” means the insolvent as that term is defined in subsection (b) of this section; (7) (i) “The estate” means the estate that is created when an assignee for the benefit of creditors or a receiver of the assets of an insolvent is appointed; (ii) “The estate” includes all property, assets, interests, and rights with respect to which the assignee or receiver is acting as a fiduciary; (8) “Order for relief” means the order appointing the assignee for the benefit of creditors or the receiver of the assets of an insolvent; (9) “Petition” means the pleading filed to commence the assignment for the benefit of creditors proceeding or receivership proceeding; (10) “Trustee” means the assignee for the benefit of creditors or receiver of the assets of an insolvent; and (11) Other words, including “insolvent” and “insider”, when used in federal bankruptcy law shall have the meanings set forth in the definition section of the federal bankruptcy law or as interpreted by the federal courts applying federal bankruptcy law. (b) (1) In this section the following words have the meanings indicated. (2) “Insolvent” means the assignor in an assignment for the benefit of creditors proceeding or the insolvent with respect to whose affairs a receiver has been appointed. (3) “Judicial lien” means a lien obtained by judgment, levy, sequestration, or other legal or equitable process or proceeding. (c) Any assignee for the benefit of creditors or receiver of the assets of an insolvent shall be vested with full title to all the property and assets of the insolvent and with full power to enforce obligations or liabilities in favor of the insolvent. (d) All preferences, payments, transfers, and obligations made or suffered by the insolvent which are fraudulent, void, or voidable under any act of the Congress of the United States relating to bankruptcy are fraudulent, void, or voidable, respectively, under this subtitle to the same extent that they would be fraudulent, void, or voidable under applicable federal bankruptcy law. (e) Any assignee for the benefit of creditors or receiver of the assets of an insolvent may set aside any: (1) Fraudulent conveyance as defined in Subtitle 2 of this title; and (2) Preference, payment, transfer, or obligation that is fraudulent, void, or voidable under subsection (d) of this section. (f) Any assignee for the benefit of creditors or receiver of the assets of an insolvent has, as of the date of the commencement of the proceeding, the rights: (1) Of a creditor that extends credit to the insolvent at the time of the commencement of the proceeding and that obtains, at such time and with respect to such credit, a judicial lien on all property on which a creditor on a simple contract could have obtained such a judicial lien, whether or not such a creditor exists; (2) Of a creditor that extends credit to the insolvent at the time of the commencement of the proceeding and obtains, at such time and with respect to such credit, an execution against the insolvent that is returned unsatisfied at such time, whether or not such a creditor exists; (3) Of a bona fide purchaser of real property, other than fixtures, from the insolvent, against whom applicable law permits such transfer to be perfected, that obtains the status of a bona fide purchaser and has perfected such transfer at the time of the commencement of the proceeding, whether or not such a purchaser exists; and (4) To avoid any preference, payment, transfer, or obligation that is fraudulent, void, or voidable under subsection (d) of this section.PreviousNext

Article - Real Property Next

§1–101. (a) In this article the following words have the meanings indicated unless otherwise apparent from context. (b) “County” includes Baltimore City. (c) “Deed” includes any deed, grant, mortgage, deed of trust, lease, assignment, and release, pertaining to land or property or any interest therein or appurtenant thereto, including an interest in rents and profits from rents. (d) (1) “Deed of trust” means a deed of trust that secures a debt or the performance of an obligation. (2) “Deed of trust” does not include a voluntary grant unrelated to security purposes. (e) “Grant” includes conveyance, assignment, and transfer. (f) “Land” means property. (g) “Land record” means any document recorded by a clerk of the circuit court relating to property. (h) “Landlord” means any landlord, including a lessor. (i) “Lease” means any oral or written agreement, express or implied, creating a landlord and tenant relationship, including any sublease and any further sublease. (j) “Mortgage” means any mortgage, including a deed in the nature of mortgage. (k) “Person” includes an individual, a receiver, a trustee, a guardian, an executor, an administrator, a fiduciary, or a representative of any kind, or any partnership, firm, association, public or private corporation, or any other entity. (l) “Property” means real property or any interest in real property. (m) “Purchaser” means a buyer or vendee. (n) “Tenant” means any tenant including a lessee. (o) “Vendor” means a seller.Next

§6–101. (a) In this title the following words have the meanings indicated. (b) “Administration” means the Maryland Port Administration. (c) “Commission” means the Maryland Port Commission. (d) “Executive Director” means the Executive Director of the Maryland Port Administration. (e) “Port facility” includes any one or more or combination of: (1) Lands, piers, docks, wharves, warehouses, sheds, transit sheds, elevators, compressors, refrigeration storage plants, buildings, structures, and other facilities, appurtenances, and equipment useful or designed for use in connection with the operation of a port; (2) Every kind of terminal or storage structure or facility useful or designed for use in handling, storing, loading, or unloading freight or passengers at marine terminals; (3) Every kind of transportation facility useful or designed for use in connection with any of these; and (4) An international trade center constituting a facility of commerce and consisting of one or more buildings, structures, improvements, and areas that the Department considers necessary, convenient, or desirable for the centralized accommodation of functions, activities, and services for or incidental to the transportation of persons by water, the exchange, buying, selling, and transportation of commodities and other property in international and national waterborne trade and commerce, the promotion and protection of this trade and commerce, and governmental services related to them and other federal, state, and municipal agencies and services, including foreign trade zones, offices, marketing and exhibition facilities, terminal and transportation facilities, customhouses, custom stores, inspection and appraisal facilities, parking areas, commodity and security exchanges, and, in the case of buildings, structures, improvements, and areas in which such accommodation is afforded, all the buildings, structures, improvements, and areas, although other parts of the buildings, structures, improvements, and areas might not be devoted to purposes of the international trade center other than the production of incidental revenue available for the expenses and financial obligations of the Department in connection with the international trade center and although other parts of the buildings, structures, improvements, and areas might be rented or leased for the use or occupancy of departments, bureaus, units, or agencies of the United States, this State, or any political subdivision of this State. (f) “Project” means any port facility acquired, constructed, controlled, or operated by the Administration, including all property acquired for the construction or operation of the port facility.PreviousNext
